A federal appeals court on Thursday overturned a decision to block a White House mandate on vaccines for federal employees.Last September, President Joe Biden said the vast majority of federal employees must be vaccinated against COVID-19 or face disciplinary action, the New York Times reported.But in January, a preliminary injunction issued by a federal judge in Texas blocked the Biden administration from enforcing the vaccine mandate.The White House said about 95 percent of federal employees had been vaccinated in compliance with the mandate before the Texas judge issued the ban.Anti-vaccine mandate protesters hold up signs.In a 2-1 vote, the U.S.Court of Appeals for the Fifth Circuit ruled that Texas federal Judge Jeffrey Brown did not have jurisdiction to block the vaccine mandate.In his previous ruling, Judge Brown said the president did not have the authority to force employees to “undergo necessary medical procedures as a condition of their employment.”Brown also said public health could be protected by other, more modest measures, such as wearing masks, social distancing and telecommuting.Brown was appointed to the U.S. District Court for the Southern District of Texas by former President Donald Trump in 2019.In its ruling on Thursday, the Fifth Circuit court of Appeals said the lawsuit challenging the vaccine mandate should be dismissed.The lawsuit was started by Feds for Medical Freedom.Biden’s vaccine mandate also applies to health care workers and certain private sector employees.As of Thursday, two-thirds of eligible Americans were fully vaccinated, according to the New York Times database.In January, the Supreme Court blocked the Biden administration from enforcing a “take nucleic acid testing or vaccination” mandate for large businesses, but allowed a more modest mandate that health workers at facilities that receive federal funds be required to be vaccinated.In December, a federal judge blocked the federal government’s third mass vaccine mandate, which had been applied to employees of federal contractors.(after)
